Thank you for your interest in our company Wohnwerkstatt.

General
These general terms and conditions (GTC) of Wohnwerkstatt, owner Rebekka Schmid, Rheinstrasse 67, 7012 Felsberg, apply to all offers, deliveries, consulting services and all other services in the areas of furnishing, living and shopping advice from raumwunder. The following terms and conditions apply between raumwunder and its customers in the version current at the time the respective service is used. If the customer concludes a written contract with Wohnwerkstatt, the GTC that are current at the time apply.
Any natural or legal person who maintains a business relationship with Wohnwerkstatt is referred to as a customer.
These terms and conditions apply exclusively. Conflicting, supplementary or deviating conditions require the express written confirmation of Wohnwerkstatt to be valid. When using the services of Wohnwerkstatt and when concluding the contract, the customer confirms that they fully accept these General Terms and Conditions, including the terms of delivery and payment.

Information fromWohnwerkstatt
Brochures and advertising material from Wohnwerkstatt and the website www.wohn-werlkstatt.ch contain information about services and products. We reserve the right to change prices and offers as well as technical changes. All information (service descriptions, illustrations, films, dimensions, weights, technical specifications and other information) are only to be understood as approximate values and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Wohnwerkstatt makes every effort to ensure that all data and information is correct, complete, up-to-date and clear, but Wohnwerkstatt cannot guarantee this, either expressly or tacitly.

Services
The furnishing suggestions and plans created by Wohnwerkstatt are only draft plans that are to be understood as a visualization of furnishing ideas. For the most part, the advice is based on information provided by the customer, for the correctness and completeness of which no guarantee can be given.
The scope of the services we provide may vary slightly in individual cases, provided this helps to understand the planning.
Wohnwerkstatt creates individual furnishing suggestions for the customers, taking into account the information they have provided. However, liability for "likes" cannot be assumed, as this is a subjective evaluation.
Product information and manufacturer information from other manufacturers are passed on to the best of our knowledge and belief, but we cannot guarantee that they are correct and up-to-date.
We do not conclude our own contracts with individual suppliers such as craftsmen, furniture stores, etc. Contracts are concluded exclusively between the supplier and the customer or third parties.
Wohnwerkstatt accepts no liability for unsatisfactory performance by third parties.

conclusion of contract
Quotations from Wohnwerkstatt are binding and valid for three weeks from the date of the quotation. The contract with Wohnwerkstatt comes about with the written order confirmation of the customer. (E-mail is sufficient.)
The customer supports Wohnwerkstatt in providing the agreed service by means of timely, clear written briefings, clear budget specifications and all necessary information.
Wohnwerkstatt has developed a questionnaire in this regard, which the customer must fill out after the order has been accepted.
If the customer changes or expands the order, this will be declared as additional expense, charged and communicated in writing.

Prices
We always calculate our fees based on the time spent. The hourly rate for the residential workshop is CHF 95. The time required includes working time excl. travel costs. Travel costs are declared in writing in the offer after prior agreement.
We invoice all of our expenses, in particular administrative work, expenses, cash outlays (travel expenses, travel allowance) and material costs (printing and paper costs, etc.).
Billable travel time also includes trips for sample procurement and clarifications.
All prices from Wohnwerkstatt are gross in CHF.

payment
The invoices from Wohnwerkstatt are due for payment net within 20 days. If the customer is in default of payment, Wohnwerkstatt can charge default interest of 5% per year. A reminder fee of CHF 20 will be charged for the third payment reminder.
Complaints by the customer do not affect the due date of the invoice. Offsetting by the customer is excluded.
After the order has been confirmed, Wohnwerkstatt is entitled to request payment on account from the customer at its discretion or to issue interim invoices.
If payments on account are not made or interim invoices are not paid, Wohnwerkstatt is entitled to stop the work and/or after the second payment reminder to request the payment due and/or to request security for the outstanding balance, or to withdraw from the contract in whole or in part.

cancellation conditions
Both parties have the right to withdraw from the contract at any time by means of a written notification. The customer owes the full remuneration for work already carried out by Wohnwerkstatt up to the time of termination and all costs incurred up to that point as well as for the time required for consultations and the costs caused by the withdrawal. The drafts and plans already created remain the property of Wohnwerkstatt.

Google reviews
If the customer makes Google reviews (evaluations) about Wohnwerkstatt, he is obliged to provide truthful and factual information that is related to the processing of the order.
Google reviews must not violate any personal rights of third parties; in particular, they must not be insulting, obscene, defamatory, harassing, defamatory, disparaging, disparaging, defamatory, untruthful, etc. be.
Wohnwerkstatt reserves the right, at its own discretion, to take legal action against unjustified ratings or ratings that violate these General Terms and Conditions. The customer has to pay the resulting costs.

privacy
The data protection regulations of Wohnwerkstatt from January 1, 2021 apply as an integral part of these terms and conditions.

Liability
Wohnwerkstatt excludes all liability for damage that has not occurred to the delivery item, regardless of its legal basis, as well as claims for damages against Wohnwerkstatt and any auxiliary persons and vicarious agents. In particular, Wohnwerkstatt is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the customer and third parties. A further mandatory statutory liability remains reserved, for example for gross negligence or illegal intent.

Further instructions
Should individual provisions of these General Terms and Conditions be void and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions will be replaced by provisions that come as close as possible to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective manner. The same applies to any loopholes in the regulation.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law norms. The UN Sales Convention (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is Chur, unless the law provides for mandatory places of jurisdiction.
